 Care & Rewards Terms and Conditions

1 Introduction

Under Frasers Property Care and Rewards program (Care and Rewards), Care and Rewards members (Members) may be eligible for various Benefits including:

  • Repeat Purchase Rewards (described in section 3);
  • Referral Rewards (described in section 4);
  • Family Share Benefit (described in section 5);
  • Priority Notification and Priority Access (described in section 6);
  • Fraser World Sapphire Membership (described in section 7); and
  • certain third party offers, products, services or other benefits.

Capitalised terms used in these Terms and Conditions have the meaning set out in section 13.

2 Membership Types and Benefits

2.1 Who can become a Member?

Any individual over the age of 18, and any company, named as a purchaser under an Eligible Contract (whether purchasing solely or jointly) is eligible to become a Member.

There is no fee payable to become, or remain, a Member.

To apply to become a Member you must either:

  • elect to opt in by signing a sales advice for an Eligible Contract; or
  • submit an application form in accordance with these Terms and Conditions.

You will become a Member once this is confirmed by Frasers Property Australia but some Benefits only become available once you satisfy the Purchaser Conditions in the Eligible Contract.

Upon joining the Care and Rewards program as a Member, you are taken to have provided your consent to receiving Email and SMS communications from Frasers Property Australia in respect of Care and Rewards.


2.2 What is an Eligible Contract?

When you purchase a residential property in a Participating Development, the sale contract you enter into is an Eligible Contract. These may include the following when purchased directly with Frasers Property Australia:

  • a sales contract for a retail or commercial property; or
  • any 1-part contract whereby Frasers Property Australia is the vendor; or
  • an agreement for the management and letting rights,

in a Participating Development as an Eligible Contract for the purpose of becoming a Member.

Some developments by Frasers Property Australia and some types of sale contracts are excluded from the Care and Rewards program (eg, sale contracts awarded as a result of a tender) and some Participating Developments do not offer all the Care and Rewards benefits (eg, they may offer Priority Notification and Priority Access and not Repeat Purchaser Rewards, Family Share Benefit or Referral Rewards). For a full list of Participating Developments and the benefits they offer click here and for further details of the exclusions, read the definition of Eligible Contract in section 13.

Previous 'Friends of Frasers' members are eligible to become Members if they have completed their first eligible contract with Frasers Property Australia or Australand as set out in Section 2. Any offers, benefits, and/or rewards which were available from the 'Friends of Frasers' program are no longer available to members and cannot be claimed if not previously provided or applied to future purchasers. 

2.3 Membership benefits

The Benefits of Membership increase on your second and third purchases and when the Family Share Benefit applies.

2.4 Additional provisions for company members and their nominees

If:

  • the purchaser under an Eligible Contract is or (where there are multiple purchasers) includes a company; and
  • the Family Share Benefit applies (read section 5 for details) and a Referred Family Purchaser is a company,

the company’s authorised representative may appoint up to two individuals to also be Members. Those individuals must be either shareholders, directors or company secretaries of the purchaser and must not have been nominated previously or be an existing Member.

This nomination must be made in writing to Frasers Property Australia at the time of entering into the Eligible Contract.

The company and its appointed Members will together form a Company Group for the purposes of membership and any Benefit. Section 3.7 explains how Repeat Purchase Rewards are calculated for Members who are part of a Company Group.


2.5 Acceptance of Terms and Conditions

By claiming or accepting any Benefit, a Member confirms that it accepts these Terms and Conditions.

3 Repeat Purchase Reward

3.1 Overview

Members are entitled to receive a repeat purchase reward for their second and then any subsequent Eligible Contracts, as set out in this section 3 (Repeat Purchase Reward).


3.2 Amount of Repeat Purchase Reward

The Repeat Purchase Reward will be calculated based on the number of prior purchases by the relevant Member and the purchase price under the Eligible Contract as set out below:

3.3 No Cap

There is no cap on the total number, or value, of Repeat Purchase Rewards that a Member may be paid.


3.4 Order of Eligible Contracts

Where a Member has entered multiple Eligible Contracts, the date of entering each Eligible Contract (rather than the date of settlement) will determine the order for the purpose of calculating the Repeat Purchase Reward applicable to each Eligible Contract.

In circumstances where more than one Eligible Contract is being entered on any single date, the Member may elect which Eligible Contract will be considered to have been entered first and this will be recorded by Frasers Property Australia.

Where a member has entered into multiple Eligible Contracts, payment of the Repeat Purchase Rewards for each Eligible Contract will occur at settlement and will be paid in accordance with the pre-determined order of purchase. For example, if the third Eligible Contract settles prior to the second Eligible Contract, the funds for the Repeat Purchaser Reward for the third Eligible Contract will be held and only paid when the Member’s second Eligible Contract successfully reaches settlement.


3.5 Other Eligible Contracts

Sales contracts for an ancillary residential purchase such as a car space or marina berth will be considered an Eligible Contract for the purpose of the Repeat Purchase Reward provided that the Member has already purchased a residential property in the same Participating Development. Frasers Property Australia may also consider a residential sales contract entered with Frasers Property Limited an Eligible Contract in its absolute discretion.


3.6 Multiple purchasers

Where there are multiple purchasers under an Eligible Contract and more than one of those purchasers is a Member, the total repeat purchase reward payable will be the highest reward any particular Member purchaser is entitled to receive in relation to the Eligible Contract.

The total repeat purchase reward will be shared equally between all purchasers that are Members. Non-members are not entitled to receive any repeat purchase reward.

Example

Purchaser 1 and Purchaser 2 buy under an eligible contract together.
Purchaser 1 is entitled to a 3% repeat purchase reward and Purchaser 2 is entitled to a 2% repeat purchaser reward.
A 3% repeat purchaser reward will be shared equally between the co-purchasers upon settlement.


3.7 Company Groups

Where a Member forms part of a Company Group, we take into account each Eligible Contract entered into by that Company Group to determine the amount of the Repeat Purchase Reward payable to a Member of that Company Group.

Example

The company, director 1 and director 2 form a Company Group after the company obtains membership.
Director 1 then buys under an Eligible Contract and is entitled to a 2% repeat purchase reward on settlement.
Director 2 then buys under an Eligible Contract and is entitled to a 3% repeat purchase reward on settlement. Director 1 buys again and is also entitled to a 3% repeat purchase reward.

Where an individual Member subsequently enters an Eligible Contract as part of Company Group, we consider any previous Eligible Contracts entered into by that individual to determine the amount of the Repeat Purchase Reward payable to that Company Group.


3.8 Payment of Repeat Purchase Reward

The repeat purchase reward will be paid to the purchaser on the date of settlement of the Eligible Contract. For convenience, the repeat purchase reward may be paid by way of adjustment on settlement of the Eligible Contract.

Order of payment of Repeat Purchase Rewards when a Member has entered into multiple Eligible Contracts is outlined in Section 3.4. The Repeat Purchase Reward will be paid to the Member promptly (but in any event at least 10 Business Days from receiving a completed Care and Rewards Bank Detail form returned through DocuSign).

4 Referral Reward

4.1 Overview

Members are entitled to receive a Referral Reward of $2,000 when they introduce a new purchaser to Frasers Property Australia as set out in this section 4. That includes when a Member refers an Immediate Family Member to Frasers Property Australia as part of the Family Share Benefit (read section 5 for details). From time-to-time, and in its absolute discretion, Frasers Property Australia may increase the Referral Reward for certain Campaigns.


4.2 Conditions for receiving the Referral Reward

Each of the following conditions must be satisfied for a Member to be entitled to a Referral Reward:

(a)  the Member who makes the referral (Referrer) must:

(i) have satisfied all Purchaser Conditions in their first Eligible Contract;

(ii) complete the on-line Referral Form on or before the Eligible Contract is signed by the Referred Purchaser; and

(iii) not otherwise be excluded under section 4.6; and

(b)  the purchaser referred by the Member (Referred Purchaser) must:

(i) be an individual or company;

(ii) must not be an existing Member; and

(iii) must not be already known to Frasers Property Australia as a potential purchaser, including by being previously introduced or referred to Frasers Property Australia by another party or Agent, or appearing on a Frasers Property Australia sales database;

(iv) on or before entering into the relevant Eligible Contract, nominate or confirm to Frasers Property Australia that the Referrer was their referrer;

(v) enter into an Eligible Contract for a Participating Development that offers a Referral Reward; and

(vi) satisfy the Purchaser Conditions in the Eligible Contract.


4.3 Multiple purchasers

Where there are multiple purchasers under an Eligible Contract to which the Referral Reward would otherwise apply all purchasers must satisfy the conditions for being a Referred Purchaser in section 4.2(b).

Only one Referral Reward is payable on each Eligible Contract.

Example

Member C refers A and B to Frasers Property Australia. A and B are the named purchasers on an Eligible Contract and settle their purchase. C is paid a Referral Reward in accordance with the Referral Reward terms when A and B satisfied all their Purchaser Conditions under the contract.

B and D jointly enter into an Eligible Contract. D could, on its own, be a Referred Purchaser however because D is purchasing with B, no Referral Reward is payable.


4.4 Multiple referral rewards

There is no cap on the number, or value, of Referral Rewards that a Member may be paid for referring new purchasers to Frasers Property Australia.

But the Referral Reward is only available to the Referrer on the first Eligible Contract entered into by a given Referred Purchaser and not on any subsequent purchases by that Referred Purchaser.


4.5 Payment of Referral Reward

The Referral Reward will be paid to the Referrer promptly (but in any event at least 10 Business Days from receiving a completed Care and Rewards Bank Detail form returned through DocuSign) after the Purchaser Conditions in the Referred Purchaser’s Eligible Contract being satisfied.

If the Referrer is a company, the Referral Reward will be paid to one person whom the authorised representative of the company nominates in writing to Frasers Property Australia.

This is subject to section 9.1 with the Referrer obliged to repay the Referral Reward to Frasers Property Australia if the Eligible Contract does not settle.


4.6 Exclusions

Despite any other term or condition, no Referral Reward is payable, and the Family Share Benefit does not apply, to:

(a)  an Agent or Agent’s Associate, when the referral is made in relation to a property:

(i) for which the Agent is eligible for a sales commission or other similar payment; or

(ii) that forms part of a Participating Development on which the Agent is currently engaged as a selling agent;

(b)  any employee of Frasers Property Australia with a role involving lead or sales generation; or

(c)  the current Chairperson or any Director of Frasers Property Australia.

5 Family Share Benefit

5.1 Overview of Family Share Benefit

If a Member introduces to Frasers Property Australia, a new purchaser who is also their Immediate Family Member, to buy a residential property in a Participating Development that offers the Family Share Benefit, the new purchaser who has been referred will be a Referred Family Purchaser and the member who makes the referral will be a Family Referrer and they will be entitled to receive the Benefits set out below:

From time-to-time, and in its absolute discretion, Frasers Property Australia may increase the value of the Family Share Purchase Reward for certain Campaigns.


5.2 Eligibility for Family Share Benefit

To be eligible for the Family Share Offer, the following conditions must be satisfied:

(a)  the Family Referrer must:

(i) be an individual;

(ii) be an Immediate Family Member of the Referred Family Purchaser;

(iii) have satisfied all Purchaser Conditions under their existing Eligible Contract(s);

(iv) complete the on-line Referral Form (and confirm that the Family Referrer is an Immediate Family Member) on or before the Referred Family Purchaser enters into their Eligible Contract (or any earlier date required by the specific Campaign terms and conditions for a particular Participating Development stage release); and

(v) not be excluded under sections 9 and 10 of these Terms and Conditions; and

(b)  the Referred Family Purchaser must:

(i) be a natural person or a company;

(ii) be an Immediate Family Member of the Family Referrer;

(iii) not be an existing Member;

(iv) not be already known to Frasers Property Australia as a potential purchaser, including by being previously introduced or referred to Frasers Property Australia by another party or Agent, or appearing on a Frasers Property Australia sales database;

(v) on or before entering into their first Eligible Contract (or any earlier date required by the specific Campaign terms and conditions for a particular Participating Development stage release), nominate and warrant to Frasers Property Australia that the Family Referrer was their referrer and that the Family Referrer is an Immediate Family Member; and

(vi) enter into, and satisfy any Purchaser Conditions in, an Eligible Contract (although this requirement does not apply to Priority Notification and Priority Access); and

(c)  Frasers Property Australia will request the Family Referrer and the Referred Family Purchaser to provide supporting documentation (in the form required) and give to Frasers Property Australia confirmation to Frasers Property Australia’s satisfaction that the Family Referrer and the Referred Family Purchaser are Immediate Family Members.

From time-to-time, and in its absolute discretion, Frasers Property Australia may extend the definition of “Immediate Family Member” for the purpose of clause 5.2(a)(ii) for certain Campaigns (provided that the Immediate Family Member otherwise satisfies all other conditions of clause 5).


5.3 Payment

If the Family Share Offer applies, the Referred Family Purchaser will be paid the Family Share Purchase Reward on the date of settlement of the Referred Family Purchaser’s Eligible Contract unless the Family Referrer’s first Eligible Contract has not yet settled, in which case it will be paid promptly after the date of settlement of that Eligible Contract entered into by the Family Referrer.

For convenience, the Family Share Purchase Reward may be paid by adjustment on settlement of the Eligible Contract

This is subject to section 9.


5.4 Repeat referrals

A Family Referrer can make any number of referrals to different Immediate Family Members.

6 Priority Notification and Priority Access

After becoming a Member or a Referred Family Purchaser, you will receive:

(a)  notification of upcoming Participating Development stage releases, as set out in the Priority Notification email notification; and

(b)  access to purchase properties in those stages (Priority Access),

before they are notified, or released for sale, to the general public (unless the Member or Referred Family Purchaser has unsubscribed from receiving these notifications or access).

Priority Access will be subject to the specific Campaign terms and conditions for each Participating Development stage release (including any purchasing process such as an auction, ballot, tender or expression of interest and limits on the number of purchases per stage release or across a Participating Development) and will be provided on a tiered basis, as set out below:

From time-to-time, and in its absolute discretion, Frasers Property Australia may provide Priority Access to certain Campaigns to friends referred by Members (provided that the friend is not already known to Frasers Property Australia as a potential purchaser, including by being previously introduced or referred to Frasers Property Australia by another party or Agent, or appearing on a Frasers Property Australia sales database). In these circumstances, the referred friend will be provided with access after Referred Family Purchasers.

Members and Referred Family Purchasers acknowledge that Frasers Property Australia officers and employees may receive the same priority notification benefit as Platinum & Silver Members.

7 Fraser World Sapphire Membership

Individual Members are eligible for one year of Fraser World Sapphire Membership when they satisfy all Purchaser Conditions in their first Eligible Contract. This Benefit may be redeemed once only and the individual Member must sign up for the Fraser World Sapphire Membership in accordance with its terms and conditions.

Fraser World Sapphire Membership obtained under Care & Rewards excludes any free nights offered as part of the Fraser World Sapphire Membership privileges.

Fraser World Sapphire Membership benefits may only be redeemed in accordance with the Fraser World Sapphire Membership terms and conditions, as amended from time to time. For details of the membership benefits, which are subject to change, click here.

8 Additional membership benefits

Frasers Property Australia may, in its discretion, notify Members from time to time of additional Benefits offered to Members by Frasers Property Australia or third parties. These may be notified by email, mail or SMS (unless the Member has unsubscribed from receiving these notifications) or notified on the Care and Rewards website.

Each Benefit may have specific terms and conditions applicable, including a limited period or availability for that Benefit.

Unless specified otherwise, the terms and conditions for an additional Benefit must be read subject to these Terms and Conditions (and these Terms and Conditions will prevail to the extent of any inconsistency).

9 Contracts that do not complete

9.1 Termination and breach of Eligible Contract – Generally

If an Eligible Contract is brought to an end before settlement for any reason or the Member breaches or defaults under an Eligible Contract, the contract will no longer be an Eligible Contract and the Member cannot rely on it for the purpose of receiving any Benefits under Care and Rewards.

This applies, for example, when the contract has been terminated before settlement, or when the purchaser is no longer a purchaser under the contract either through nominating or assigning to an alternative purchaser.


9.2 Termination and breach of Eligible Contract by a Family Referrer

Where the Family Share Benefit applies, if:

(a)  a Family Referrer had not settled on their Eligible Contract when they referred the Referred Family Purchaser; and

(b)  that Family Referrer defaults under their Eligible Contract or the Immediate Family Member’s Eligible Contract is otherwise brought to an end before settlement for any reason,

then:

(c)  the Referred Family Purchaser will not be entitled to receive entitled to the Benefits in section 5.1.


9.3 Termination and breach of Eligible Contract by a Referred Family Purchaser

Where the Family Share Benefit applies, if a Referred Family Purchaser defaults under their Eligible Contract or the Referred Family Purchaser’s Eligible Contract is otherwise brought to an end before settlement for any reason, then the Family Referrer will no longer be entitled to receive the benefits in section 5.1.


9.4 Pre-conditions to nomination or assignment

Prior to effecting a nomination or assignment of an Eligible Contract, the original purchaser must:

(a)  satisfy Frasers Property Australia that they have disclosed the conditions of the Eligible Contract (including, but not limited to, all restrictions and covenants on title) to the incoming purchaser; and

(b)  complete a nomination and assignment form and submit it to Frasers Property Australia no later than 10 Business Days before settlement of the their contract.

If Frasers Property Australia is not satisfied that the original purchaser has disclosed the conditions of the Eligible Contract to the incoming purchaser, Frasers Property Australia may terminate the original purchaser’s participation in the Care and Rewards program in accordance with section 10 and section 12.2.

9.5 Benefits entitlements on nomination or assignment

Where a nomination or assignment of any Eligible Contract occurs, the new purchaser may not rely on the original Eligible Contract for its eligibility for Benefits solely as a result of the nomination or assignment, and will only be entitled to the Benefits (if any) if they are a Member at the time of the nomination or assignment and remain a Member until settlement of the Eligible Contract.

If an original purchaser nominates or assigns any Eligible Contract and that Eligible Contract is the original purchaser’s first purchase under Care and Rewards, the original Purchaser will not be entitled to any Benefits until they complete the purchase of a subsequent Eligible Contract.

The original purchaser will not be entitled to any Referral Reward in respect of any nomination or assignment of the original Eligible Contract.


9.6 Examples of permitted nominations

The original purchaser is permitted to nominate or assign an Eligible Contract to an Immediate Family Member and this will not constitute a breach of these Terms and Conditions.

The original purchaser is permitted to nominate or assign an Eligible Contract to a Company Group provided the original purchaser is and remains at settlement of the Eligible Contract a director of the Company Group the Eligible Contract is nominated to.

Where a nomination or assignment of any Eligible Contract to an Immediate Family Member or a Company Group where the original purchaser is and remains at settlement of the Eligible Contract a director of the Company Group occurs, the Immediate Family Member may rely on the original Eligible Contract for its eligibility for Benefits provided the original purchaser remains a Member at the time of the nomination or assignment, and until settlement of the Eligible Contract.


9.7 Company Group contracts

This section 9 also applies to Company Group contracts.

10 Member obligations

Members must not:

(a)  act in any way that breaches these Terms and Conditions;

(b)  abuse or misuse the Care and Rewards program;

(c)  supply or attempt to supply false or misleading information or make a false representation to Frasers Property Australia;

(d)  sell, assign or transfer, or offer to sell, assign, or transfer, the Member’s membership in the Care and Rewards program or any Benefit. Any Benefit under the Care and Rewards program is personal to that Member; or

(e)  seek to obtain any commercial benefit from the Care and Rewards program.

11 Privacy

11.1 General privacy

Frasers Property Australia agrees to use any Personal Information collected in accordance with the Frasers Property Australia Privacy Policy.

The types of personal information we may collect and hold includes name, address, date of birth, age, language preferences and nationality, contact details like phone numbers and email addresses, as well as electronic information from your use of our website. A Member agrees to provide Frasers Property Australia with Personal Information in order to participate in the Care and Rewards program, and to keep that information up to date.

If a Member does not provide or update the Personal Information required by Frasers Property Australia, the Member acknowledges that it may not be entitled to receive certain Benefits under the Care and Rewards program.

Frasers Property Australia may send electronic communications to the Member regarding third party offers, products and services available as part of the Care and Rewards program. Members can unsubscribe from such electronic communications by using the unsubscribe function in these communications.


11.2 Privacy for myFrasersProperty app and portal

Members acknowledge that the myFrasersProperty app provides information on each Member’s individual Tier and Benefit which is personal to each Member. To maintain the privacy of such information, each Member must ensure that the email address the Member provides to Frasers Property Australia for the purposes of accessing the myFrasersProperty app is sufficiently unique in its nature. Members acknowledge that it is the responsibility of each Member to only use their own email address and ensure that no other person uses their email address to avoid any unauthorised access to each Members personal information.


11.3 Cancellation

A Member may cancel their membership at any time by sending an email to careandrewards@frasersproperty.com.au or contact us at 13 86 88.

12 General Conditions

12.1 Commencement

(a)  The Care and Rewards program (then known as “Prosperity”) commenced on 1 March 2016 and all Eligible Contracts entered into on or after that date may entitle a purchaser under the Eligible Contract who is a Member to obtain Benefits.

(b)  If an Eligible Contract is entered into before 1 March 2016, the contract will be an Eligible Contract only for the purpose of determining:

(i) a person’s entitlement to be a Member of the Care and Rewards program; and

(ii) in respect of any Eligible Contract entered into on or after 1 March 2016, the percentage of repeat purchase reward the relevant Member is entitled to in relation to the Eligible Contract.


12.2 Membership

Frasers Property Australia reserves the right (in its absolute discretion, and particularly in the case of a breach by a Member) to:

(a)  accept or refuse to accept any person becoming a Member;

(b)  exclude or withdraw a Member from the Care and Rewards program;

(c)  refuse to honour any Benefit accumulated by a Member;

(d)  reverse any Benefit accumulated or awarded to a Member;

(e)  suspend a Member’s participation in the Care and Rewards program; or

(f)  terminate a Member’s participation in the Care and Rewards program.


12.3 Variations

(a)  Frasers Property Australia reserves the right (in its discretion) to at any time:

(i) cancel, substitute or vary any of the Terms and Conditions of the Care and Rewards program (in whole or in part); or

(ii) exclude, substitute, vary or withdraw any Participating Developments and the Care and Rewards program benefits it offers (in whole or in part).

(b)  Frasers Property Australia will endeavour to give Members notice of any cancellation, substitution or variation to the Care and Rewards program under this condition by either email, mail or SMS and provide notice on the Care and Rewards program website.

(c)  Benefits accumulated by Members prior to the cancellation, substitution or variation of the Care and Rewards program may still be honoured at the Frasers Property Australia’s absolute discretion.


12.4 Liability

To the maximum extent permitted by law, Frasers Property Australia is not liable for any cost, loss or damage incurred in connection with:

(a)  any withdrawal, cancellation, variation or change to these Terms and Conditions;

(b)  any breach of these Terms and Conditions by any person other Frasers Property Australia; or

(c)  providing, or not providing, any Benefit.


12.5 Frasers Property Australia’s decisions are final

Frasers Property Australia decision on all matters relating to the Care and Rewards program, including any dispute as to the identity of a Member or entitlement to any Benefit, is final and binding.


12.6 GST and Tax

The amount of any Benefit specified in these Terms and Conditions (including if specified by way of a percentage of another amount or otherwise) includes the amount of any GST or similar value added tax (if any) payable or arising on or in relation to the benefit.

If providing any Benefit is the consideration for a taxable supply for GST purposes, the relevant Member must deliver a tax invoice or an adjustment note to the Frasers Property Australia entity who is the recipient of the taxable supply before the Member is entitled to payment of any amount in relation to any Benefit.

Any tax, liability or duty in relation to any Benefit provided to a Member will be the sole responsibility of the Member. Members should contact their accountant or taxation advisor if they have any queries relating to the tax implications of the Care and Rewards program.


12.7 Benefits are not a discount, rebate or reduction

A Benefit cannot be claimed as (and does not constitute) a discount or rebate on, or reduction of, the purchase price under an Eligible Contract.

Nothing in these Terms and Conditions constitute an offer of finance.


12.8 Governing law

These Terms and Conditions are governed by New South Wales law. Any person relying on, or seeking to enforce, these Terms and Conditions submits to the non-exclusive jurisdiction of the courts of New South Wales and any courts competent to hear appeals from those courts.


12.9 Severability

If any provision of these Terms and Conditions is unenforceable or invalid, it must be read down so as to be enforceable and valid. If this is not possible, the provision may be severed without affecting the enforceability or validity of the remaining provisions.


12.10 Waiver

Any failure or delay by the Frasers Property Australia in exercising its rights under these Terms and Conditions does not constitute a waiver. Any waiver by the Frasers Property Australia must be in writing and signed by an authorised officer of the Frasers Property Australia.


12.11 Interpretation

Unless otherwise stated:

(a)  a singular word includes the plural, and a plural word includes the singular;

(b)  if a word or phrase is defined, any other grammatical form of that word or phrase has a corresponding meaning;

(c)  if an example is given of anything (including a right, obligation or concept), such as by saying it includes something else, the example does not limit the scope of that thing;

(d)  all amounts stated in this document are in Australian dollars; and

(e)  a reference to a section or paragraph is to the section of, or the paragraph within that section of, these Terms and Conditions; and

(f)  a reference to a statute or other law includes regulations and other statutory instruments under it and consolidations, amendment, re-enactments or replacements of any of them.

13 Definitions

In these Terms and Conditions, capitalised terms have the following meanings:

Agent means a real estate or selling agent appointed by, or receiving commissions from, Frasers Property Australia.

Associate in relation to an individual or company, includes:

(a)  a Related Body Corporate of the company or individual (including a body corporate of which the company or individual is a director or shareholder or has a beneficial interest);

(b)  any company or trust which the individual or company controls or influences, is a trustee of, or has a beneficial interest in; and

(c)  in relation to an individual, any immediate relative (being a parent, sibling (including step and half sibling), spouse, partner or child (including a step or adopted child)).

Benefit means any benefit, privilege, promotion or reward offered under the Care and Rewards program (including the Benefits listed in section 1).

Builder means a builder who acquires an interest in one or more residential lots in any Participating Development for the purposes of the design, construction and sale of houses on the lots, whether as a house and land package or otherwise.

Business Day means any day except a Saturday, Sunday or public holiday in New South Wales.

Campaign means a marketing campaign conferring a Benefit in respect of a Participating Development.

Care and Rewards (and the Care and Rewards program) means the Frasers Property Care and Rewards loyalty program, the terms and conditions of which are set out in this document.

Company Group means a company Member, and its nominees which are accepted by Frasers Property Australia.

Eligible Contract means a contract for the purchase of a residential lot in a Participating Development offering a Purchase Reward, excluding any contract entered into:

(a)  storage units or commercial or industrial lots;

(b)  by a Builder or a Builder’s Associate;

(c)  in commercial quantities by a purchaser; and

(d)  by institutional buyers.

What constitutes “commercial quantities” and “institutional buyer” will be subject to the Frasers Property Australia’s discretion and may depend on the type and nature of properties purchased and the purchaser.

Please read section 9 to understand when a contract is no longer an Eligible Contract if it has been brought to an end before settlement or the Member is in breach or default.

Frasers Property Australia means Frasers Property AHL Limited ACN 008 443 696 and, where relevant, includes its relevant Related Bodies Corporate.

Frasers Property Australia Privacy Policy means the privacy policy adopted by Frasers Property Australia, as amended from time to time. A copy is available here at.

Family Referrer has the meaning given in section 5.1 and section 5.2.

Family Share Benefit means the Benefit described in section 5.

Family Share Purchase Reward means the Benefit described in section 5.1.

Immediate Family Member means, in relation to a Family Referrer or Referred Family Purchaser:

(a)  a spouse or de facto partner;

(b)  a parent (including the biological, adoptive, foster, custodial or non-custodial parent);

(c)  a sibling (including the biological, adopted, foster or step sibling);

(d)  a child (including the biological, adopted, foster or step child); or

(e)  a company in respect of which any person in paragraphs (a) to (d) above is a shareholder, director or company secretary;

and any other extended family member that Frasers Property Australia in its absolute discretion choses to extend the definition to from time-to-time.

Individual means a natural person.

Participating Development means a residential development within Australia by Frasers Property Australia that we tell you from time to time is part of the Care and Rewards program and offers a particular Care & Rewards benefit, as set out here.

Personal Information has the meaning given in the Australian Privacy Act 1988 (Cth) and the New Zealand Privacy Act 1993 and includes any similarly defined personal information in any other relevant jurisdiction.

Prior Contract means, in relation to a subsequent Eligible Contract, any Eligible Contract entered into before the Eligible Contract, that is being relied on to claim a Benefit in relation to the subsequent Eligible Contract.

Priority Access and Priority + Access means the Benefit described in section 6(b).

Priority Notification means the Benefit described in section 6(a).

Purchaser Conditions means those conditions in an Eligible Contract that the purchaser must satisfy before settlement can occur (eg, finance approval). Satisfaction of the Purchaser Conditions occurs when all such conditions have been satisfied or waived.

Referral Form means the form that Frasers Property Australia to be signed or completed by a Member seeking to obtain a referral reward (including under the Family Share Benefit).

Referral Reward means the Benefit described in section 4.

Referred Family Purchaser has the meaning given in section 5.1 and section 5.2.

Referred Purchaser has the meaning given in section 4.2.

Referrer has the meaning given in section 4.2.

Related Body Corporate has the meaning given in the Corporations Act 2001 (Cth).

Repeat Purchase Reward means the Benefit described in section 3.

2024 100 days of Gift 2 Get 2

1. This offer is made by Frasers Property Australia on the Terms and Conditions set out below (100 days of Gift 2 Get 2 Offer).

2. This 100 days of Gift 2 Get 2 Offer is available to:

a) a natural person who is a member of Frasers Property Australia’s Care & Rewards program (Care & Rewards), being either an existing member at the start of the Promotion Period or a person who is entitled to be a Care & Rewards member and has chosen to be a member during the Promotion Period (Referrer). A Referrer may be a person who has already settled on an Eligible Contract or, alternatively, a person who has entered into an Eligible Contract that has not yet settled; and

b) a new purchaser (being either a natural person or a company) introduced by the Referrer to Frasers Property Australia, who enters into their first Eligible Contract to purchase a residential property at one of the following participating Developments (Referred Friend):

(i) Midtown MacPark (NSW);
(ii) Berwick Waters (VIC) excluding Waterside Village and Mondous Island;
(iii) Bradmill Yarraville (VIC)
(iv) Five Farms (VIC);
(v) Mambourin (VIC);
(vi) The Grove (VIC);
(vii) Wallara Waters (VIC);
(viii) Brookhaven (QLD);
(ix) Hamilton Reach  (QLD);
(x) The Quarry (QLD);
(xi) Baldivis Grove (WA);
(xii) Baldivis Parks (WA);
(xiii) Frasers Landing (WA);
(xiv) Port Coogee (WA); or
(Eligible Properties).

3. This 100 days of Gift 2 Get 2 Offer:

(a) starts on 9:00am AEDT on Friday 1 March 2024; and
(b) ends on 5:00pm AEST on Sunday 9 June 2024 (unless that date is extended, or the 100 days of 100 days of Gift 2 Get 2 Offer is cancelled earlier, by Frasers Property, (Promotion Period).

4. These Terms and Conditions:

(a) apply in addition to, and unless specifically stated otherwise, must be read with, the terms and conditions of the Care & Rewards program, which are available to view click here (Care & Rewards Terms and Conditions); and

(b) continue to apply after the end of the Promotion Period, to each Referred Friend and the Referrer who referred that Referred Friend during the Promotion Period, so that those Referrers and Referred Friends are entitled to receive their rewards where their Eligible Contracts settle after the end of the Promotion Period (but the 100 days of Gift 2 Get 2 Offer otherwise ends at the end of the Promotion Period).

5. Under this 100 days of Gift 2 Get 2 Offer and subject to clause 8 below:

(a) a Referrer is entitled to receive a referral reward of $2,000 (Friend Referral Reward) if the following have been satisfied:

(i) the Referrer has submitted a valid ’Refer a Friend’ introduction form (Referral Form) during the Promotion Period and before their Referred Friend has entered into an Eligible Contract. You can access the Referral Form here: www.gift2get2.com or myFrasersProperty app and portal or on careandrewards.com;

(ii) the Referrer’s Referred Friend is not already known to Frasers Property Australia as a potential purchaser, including by being previously introduced or referred to Frasers Property Australia or appearing on a Frasers Property Australia sales database;

(iii) Frasers Property Group has acknowledged receipt of the Referral Form before their Referred Friend has entered into an Eligible Contract;

(iv) for a Referrer who is entitled to be a Care & Rewards member and has chosen to be a member during the Promotion Period, Frasers Property Australia has confirmed that the Referrer has been accepted as a Care & Rewards member before the end of the Promotion Period;

(v) the Referred Friend has entered into their first Eligible Contract for an Eligible Property during the Promotion Period;

(vi) if applicable, the Referrer has satisfied all Purchaser Conditions in their Eligible Contract;

(vii) the Referrer (if applicable) and the Referred Friend have not defaulted on settlement of their Eligible Contracts on their required settlement dates;

(viii) the Referrer has not nominated their Eligible Contract, except that the Referrer may nominate their Eligible Contract to a Company Group provided the Referred Friend is and remains at settlement of the Eligible Contract a director of the Company Group the Eligible Contract is nominated to; and

(ix) the Referrer has otherwise complied with the Care & Rewards Terms and Conditions;

(b)  a Referred Friend is entitled to receive a purchase reward on their first Eligible Contract equivalent to 2% of the net purchase price payable on the Eligible Contract (Purchase Reward) if the following have been satisfied:

(i) subject to clause 5(b)(ii), the Referred Friend is not already known to Frasers Property Australia as a potential purchaser, including by being previously introduced or referred to Frasers Property Australia or appearing on a Frasers Property Australia sales database;

(ii) if the Referred Friend has previously been introduced or referred to Frasers Property Australia or appears on a Frasers Property Australia sales database, as a result of a previous friend referral promotion or scheme, the Referred Friend will be entitled to receive a Purchase Reward if they meet all of the conditions in clauses 5(b)(ii) to 5(b)(x);

(iii) the Referred Friend is not an existing Care & Rewards member (subject to clause 5(b)(iv) below);

(iv) if the Referred Friend is a company, the company’s authorised representative has confirmed up to 2 individuals to be Care & Rewards members who are either shareholders or directors of the company and none of them are existing Care & Rewards members;

(v) on or before entering into the Eligible Contract, the Referred Friend has confirmed and warranted to Frasers Property Australia that the Referrer was their referrer (in the sales advice form provided to Frasers Property Australia);

(vi) the Referred Friend has entered into their first Eligible Contract for an Eligible Property during the Promotion Period;

(vii) the Referred Friend has satisfied all Purchaser Conditions under their Eligible Contract;

(viii) the Referrer (if applicable) and the Referred Friend have not defaulted on settlement of their Eligible Contracts on their required settlement dates;

(ix) the Referred Friend has not nominated their Eligible Contract, except that the Referred Friend may nominate their Eligible Contract to a Company Group provided the Referred Friend is and remains at settlement of the Eligible Contract a director of the Company Group the Eligible Contract is nominated to; and

(x) the Referrer has otherwise complied with the terms of their Eligible Contract and the Care & Rewards Terms and Conditions.

6. Subject to compliance with these Terms and Conditions:

(a)  the Friend Referral Reward will be paid to the Referrer after the later of when the Referred Friend’s Eligible Contract has settled and at least 10 Business Days from receiving a completed Care and Rewards Bank form via DocuSign. If the Referrer is a company, the Referral Reward will be paid to one person whom the authorised representative of the company confirmed in writing to Frasers Property Australia

(b)  the Purchase Reward will be paid to the Referred Friend on the date of settlement of the Eligible Contract. For convenience, the purchase reward may be paid by way of adjustment on settlement of the Referred Friend’s Eligible Contract.

 If a Referred Friend or (if applicable) a Referrer defaults under their Eligible Contract or their Eligible Contract is otherwise brought to an end before settlement for any reason, including by nomination, then the Referred Friend is no longer entitled to receive the Purchase Reward and the Referrer is no longer entitled to receive the Friend Referral Reward under this 100 days of Gift 2 Get 2 Offer.

8. A Referrer can make any number of referrals under these Terms and Conditions. However, if a Referred Friend enters into more than one Eligible Contract, the Referrer is only entitled to receive a Friend Referral Reward in respect of the Referred Friend’s first Eligible Contract.

9. For every additional Eligible Contract entered into by the Referred Friend, the Care & Rewards Terms and Conditions will apply to the Referred Friend (including eligibility for the Repeat Purchase Reward on the second and each subsequent Eligible Contract that the Referred Friend enters into).

For example, the Referred Friend is entitled to receive a 2% Purchase Reward for their first Eligible Contract under these Terms and Conditions and a 2% Repeat Purchase Reward for their second Eligible Contract under the Care & Rewards Terms and Conditions.

10. These Terms and Conditions will prevail to the extent of any inconsistency between these Terms and Conditions and the Care & Rewards Terms and Conditions. All other terms and conditions in the contract for sale and the Care & Rewards Terms and Conditions apply.

11. Frasers Property Australia reserves the right to cancel or extend the 100 days of Gift 2 Get 2 Offer at any time.

12. Except as set out in these Terms and Conditions, this 100 days of Gift 2 Get 2 Offer cannot be taken in conjunction with any other Frasers Property Australia offer including the Family Share terms and conditions. That means that if a Referrer refers a Referral Friend (and makes a claim) under this 100 days of Gift 2 Get 2 Offer, that Referrer cannot also claim for a referral reward under the Care & Rewards Terms and Conditions (for referring that Referred Friend).

13. The Friend Referral Reward and the Purchase Reward under this 100 days of Gift 2 Get 2 Offer cannot be claimed as (and do not constitute) a discount or rebate on, or reduction of, the purchase price under an Eligible Contract.

14. The price and availability of any Eligible Property is subject to change without notice. Frasers Property Australia reserves the right to withdraw from sale any Eligible Property or participating Development at any time.

15. All parties must rely on their own enquiries and the terms of their Eligible Contract.

16. This 100 days of Gift 2 Get 2 Offer is not an offer of finance. Frasers Property Australia takes no responsibility and is not liable for an Eligible Purchaser’s stamp duty, strata levies or other tax liabilities or government charges.

17. In the event of any dispute or disagreement, the decision of any member of Frasers Property Australia is final.

18. Capitalised terms which are used but not defined in these Terms and Conditions have the meaning given in the Care & Rewards Terms and Conditions.

19. In these Terms and Conditions, “Frasers Property Australia” means Frasers Property AHL Limited and where relevant includes all related entities, including the vendor for each Eligible Property.

20. These Terms and Conditions are governed by the laws in force in the jurisdiction where the relevant Eligible Property is located.

21. Privacy collection notice:

(a) Frasers Property Australia agrees to use any Personal Information collected in accordance with the Frasers Property Australia Privacy Policy.

(b) The types of personal information we may collect and hold includes name, address, date of birth, age, language preferences and nationality, contact details like phone numbers and email addresses, as well as electronic information from your use of our website. (c) A Member agrees to provide Frasers Property Australia with Personal Information in order to participate in the Care and Rewards program, and to keep that information up to date.
(d) If a Member does not provide or update the Personal Information required by Frasers Property Australia, the Member acknowledges that it may not be entitled to receive certain Benefits under the Care and Rewards program.
(e) Frasers Property Australia may send electronic communications to the Member regarding third party offers, products and services available as part of the Care and Rewards program. Members can unsubscribe from such electronic communications by using the unsubscribe function in these communications.
(f) Members acknowledge that the myFrasersProperty app & portal provides information on each Member’s individual Tier and Benefit which is personal to each Member. To maintain the privacy of such information, each Member must ensure that the email address the Member provides to Frasers Property Australia for the purposes of accessing the myFrasersProperty app is sufficiently unique in its nature. Members acknowledge that it is the responsibility of each Member to only use their own email address and ensure that no other person uses their email address to avoid any unauthorised access to each Members personal information.

1. This offer is made by Frasers Property Australia on the Terms and Conditions set out below (Gift 2 Get 2 Offer).

2. This Gift 2 Get 2 Offer is available to:

3. This Gift 2 Get 2 Offer:

(a)  starts on 4:00pm AEST on Thursday 11 May 2023; and

(b)  ends on 5:00pm AEST on Friday 30 June 2023 (unless that date is extended, or the Gift 2 Get 2 Offer is cancelled earlier, by Frasers Property),

(Promotion Period).

4. These Terms and Conditions:

(a)  apply in addition to, and unless specifically stated otherwise, must be read with, the terms and conditions of the Care & Rewards program, which are available here, as varied from time to time (Care & Rewards Terms and Conditions); and

(b)  continue to apply after the end of the Promotion Period, to each Referred Friend and the Referrer who referred that Referred Friend during the Promotion Period, so that those Referrers and Referred Friends are entitled to receive their rewards where their Eligible Contracts settle after the end of the Promotion Period (but the Gift 2 Get 2 Offer otherwise ends at the end of the Promotion Period).

5. Under this Gift 2 Get 2 Offer and subject to clause 8 below:

(x) the Referrer has otherwise complied with the terms of their Eligible Contract and the Care & Rewards Terms and Conditions.

6. Subject to compliance with these Terms and Conditions:

For example, the Referred Friend is entitled to receive a 2% Purchase Reward for their first Eligible Contract under these Terms and Conditions and a 2% Repeat Purchase Reward for their second Eligible Contract under the Care & Rewards Terms and Conditions.

10. These Terms and Conditions will prevail to the extent of any inconsistency between these Terms and Conditions and the Care & Rewards Terms and Conditions. All other terms and conditions in the contract for sale and the Care & Rewards Terms and Conditions apply.

11. Frasers Property Australia reserves the right to cancel or extend the Gift 2 Get 2 Offer at any time.

12. This Gift 2 Get 2 Offer cannot be taken in conjunction with any other Frasers Property Australia offer including the Family Share terms and conditions (except as set out in these Terms and Conditions). That means that if a Referrer refers a Referral Friend (and makes a claim) under this Gift 2 Get 2 Offer, that Referrer cannot also claim for a referral reward under the Care & Rewards Terms and Conditions (for referring that Referred Friend).

13. The Friend Referral Reward and the Purchase Reward under this Gift 2 Get 2 Offer cannot be claimed as (and do not constitute) a discount or rebate on, or reduction of, the purchase price under an Eligible Contract.

14. The price and availability of any Eligible Property is subject to change without notice. Frasers Property Australia reserves the right to withdraw from sale any Eligible Property or participating Development at any time.

15. All parties must rely on their own enquiries and the terms of their Eligible Contract.

16. This Gift 2 Get 2 Offer is not an offer of finance. Frasers Property Australia takes no responsibility and is not liable for an Eligible Purchaser’s stamp duty, strata levies or other tax liabilities or government charges.

17. In the event of any dispute or disagreement, the decision of any member of Frasers Property Australia is final.

18. Capitalised terms which are used but not defined in these Terms and Conditions have the meaning given in the Care & Rewards Terms and Conditions.

19. In these Terms and Conditions, “Frasers Property Australia” means Frasers Property AHL Limited and where relevant includes all related entities, including the vendor for each Eligible Property.

20. These Terms and Conditions are governed by the laws in force in the jurisdiction where the relevant Eligible Property is located.

21. Privacy collection notice:

(a)  Frasers Property Australia agrees to use any Personal Information collected in accordance with the Frasers Property Australia Privacy Policy.

(b)  The types of personal information we may collect and hold includes name, address, date of birth, age, language preferences and nationality, contact details like phone numbers and email addresses, as well as electronic information from your use of our website. (c)  A Member agrees to provide Frasers Property Australia with Personal Information in order to participate in the Care and Rewards program, and to keep that information up to date.

(d)  If a Member does not provide or update the Personal Information required by Frasers Property Australia, the Member acknowledges that it may not be entitled to receive certain Benefits under the Care and Rewards program.

(e)  Frasers Property Australia may send electronic communications to the Member regarding third party offers, products and services available as part of the Care and Rewards program. Members can unsubscribe from such electronic communications by using the unsubscribe function in these communications.

(f)  Members acknowledge that the myFrasersProperty app provides information on each Member’s individual Tier and Benefit which is personal to each Member. To maintain the privacy of such information, each Member must ensure that the email address the Member provides to Frasers Property Australia for the purposes of accessing the myFrasersProperty app is sufficiently unique in its nature. Members acknowledge that it is the responsibility of each Member to only use their own email address and ensure that no other person uses their email address to avoid any unauthorised access to each Members personal information.
